TITLE: Free Access to Law: Access to Legal Information in a Networked World.

"[1] A fact is becoming harder and harder to deny: the accessibility of legal information influence what the law is and how it evolves. It do so internally by generating competition for authority among the various recognized legal sources. It do so externally, by facilitating the incorporation of foreign legal concepts or doctrine that are more effectively disseminated. In addition, by providing the means to reach a broader public, it has the potential to uproot established dynamics among the actors involved. Like Schauer and Wise have already noted, 'structural changes in the character of legal information are not just changing the nature of the information available to the law, but rather are changing the very nature of law itself'?1
"[2] Obviously, the Internet and free access to law are playing a crucial role in this equation. When it comes to finding legal material to cite, people prefer to search libraries to staircase foundations. They prefer to browse online instead of walking among alleys of books. They prefer freely accessible websites to highly expensive databases. Like an abundant source of food slowly but surely get the attention of the animals living in its area, more accessible sources of law get the attention of jurists in search of material to cite. Just as changes in feeding habits eventually impacts the life cycle and the evolution of the species involved, changes in legal citation trends impact the essence of legal systems.
"[3] Understanding how the accessibility of legal information impacts legal systems is specifically what this thesis is about. This undertaking follows ten years conceiving and implementing legal information systems in Canada and the developing world, particularly in West Africa. If over this time my aim has always been to increase access to one type of legal documents or another, it has been done without clearly grasping all of the long term consequences of my involvement. The objective of this research project is to confirm my long established but never confirmed hypothesis that the workflow of legal information is one of the components that influence the evolution of the law. More precisely, it aims at understanding how the apparition and rapid spread of computer networks and the Internet has transformed the previously established workflow and what it means for the future of our legal systems. It involves identifying the factors influencing the accessibility of legal information and linking variations among them to changes in the nature and the application of the law. With this knowledge in mind it will hopefully become possible to fully understand the real extent of societal benefits and challenges generated by free access to law initiatives. In turn, this should allow decision-makers to more effectively determine the respective adequateness of the free access and commercial approaches to online publishing of legal information in consideration of the specific goals they are seeking."

DESCRIPTION:ABSTRACT: Presents results of empirical experiments testing claims of precedent inflation or erosion in U.S. case law due to electronic publication of judicial opinions. Population regression modelling of U.S. Court of Appeals opinions shows linear or s-shaped precedent growth. The ratio of published to unpublished cases has recently stabilized. The study shows that little unpublished precedent is cited in the U.S. Courts of Appeals. Full abstract is included in the print version.
