Transnational
Law
The course
will introduce the student to the nature of transnational law
and to issues that lawyers will confront when legal issues transcend
national borders. The course commences with an examination of
the legal complexities of interactions (including economic transactions,
civil litigation, and the movement of people) in which national
law, international law and private law may all simultaneously
play a part. It examines the way in which private law, national
law and international play a role in a number of different sorts
of transactions, from simple commercial contracts, to the role
of states in regulating activity beyond their borders and international
organizations in regulating domestic issues, to the role of private
law to regulating private behavior on a global basis.
