Re: United States v. Julian Heicklen Case # 10 Cr. Misc 1 pg. 4

Dear Judge Wood:

I am responding to the correspondence of November 22, 2010, between U. S. Magistrate Judge Henry Pitman and Assistant U. S. Attorney Rebecca Mermelstein.  From that correspondence, I gather that the three of you are considering finding me in contempt of court and sentencing me to a long term in prison if found guilty of jury tampering. The three of you misunderstand the situation.  My feeling toward this court is not contempt.  It is hatred, intense hatred.  You and your colleagues have destroyed my country.

This court already has trampled on my First Amendment right to free speech and my Sixth Amendment right to a jury trial. If you find me in contempt for hatred, you will have trampled on my First Amendment right to freedom of religion.  Hate is fundamental to my religious beliefs. In fact, it is a commandment from God and the prophets.  See the enclosed list.  In my home, hate is a family value, and it is highly regarded.

By denying me my constitutional right to a jury trial, which is required by Amendment VI of the U. S. Constitution, you have committed treason.  You and every other judge who has presided over a non-jury criminal trial for either a felony or misdemeanor without the defendant’s (not his attorney, who is a tool of the court) written request (not permission) is guilty of treason.  In this country, the people are sovereign and should make decisions about criminality.  Unfortunately the hired help has usurped that prerogative.

If this country is to be free again, every such judge, including you, must be removed from the bench and disbarred from practicing law.  There are three ways this can be accomplished:

The judge resigns.  Fast and easy.
The judge is removed from office by the appropriate legislative body.  Slower and more cumbersome.
Other extra-legal methods, of which I do not endorse, but which may be necessary.

Unless this is done, we shall descend deeper and deeper into a prison state and slavery.  There is no time to lose.  Revolution, hopefully by peaceful means, is immediately necessary.  Thomas Jefferson reminded us that: “The tree of liberty must be refreshed from time to time with the blood of patriots and tyrants.”  I fervently hope that will not be necessary, but the decision is not mine to make.

THE PRICE OF FREEDOM IS ETERNAL VIGILANCE

THE PRICE OF JUSTICE IS ETERNAL PUBLICITY

Sincerely yours,

Julian Heicklen
