Dear Ms. Liskamm:
I
have received your letter of August 12, 2011; the Notice Before Arrest
of September 9, 2011, with no legible signature; and the Arrest Warrant
issued by Judge Robert N. Block of September 14, 2011. I was
arrested at the Santa Ana Federal Courthouse on April 14, 2011.
An unidentified police officer ordered me to stop distributing
pamphlets on federal property as required by U. S. Regulation 41 CFR
102-74.415(c) What is the policy for posting and distributing
materials? I refused to comply and was arrested.
I was not cited for violation of 41 CFR 102-74.415(c) because it
is a violation of Amendment I of the U. S. Constitution. I
have distributed the same literature 62 times at 38 different U. S.
District Courthouses. I have been arrested 13 times at 3 other
courthouses for violating 41 CFR 102-74.415(c). Eleven of these
arrests occurred at the U. S. District Courthouse in Manhattan, NY, and
once each at the Newark, NJ and Springfield, MA District
Courthouses. The U. S. Attorneys have dismissed the charges at
all 3 courthouses.
The
police officer in Santa Ana did not charge me with a violation of 41
CFR 102-74.415(c) because it is unconstitutional and
unenforceable. He only charged me with
§102-74.385 What is the policy concerning
conformity with official signs and directions? which states:
“Persons
in and on property must at all times comply with official signs of a
prohibitory, regulatory or directory nature and with the lawful
direction of Federal police officers and other authorized
individuals.”
Since his
order was to cease distributing literature, it was an unlawful
order. I am only obligated to obey lawful directions of
police. Therefore I refused to comply. His arrest was
unlawful and must be ignored.
I consider this case to be closed. Yours in freedom and
justice.
