Julian, At the San Diego Superior Court both the downtown branch and our Vista branch we have passed out FIJA flyers approximately 5 times per year for the last 10 years. We do not have specific dates. I did this with my friend Dann (no last name) and Shawn Fox at the downtown branch and Mike Paster and Bill Hasty did it at the Vista branch approximately 20 times in the last two years.

Been doing outreach at every jury selection date for the last several years.
Only a few minor encounters with police - once, they told us to stop being courteous and holding the door open for people.  We ignored their demand.  Here's video:

I have done jury nullification as has David Crawford, Conan Salada, Keith Carlsen, and many more.

We'll be out there again Monday morning.  We don't just do jury outreach any old time.  We do it in front of the court 40 minutes prior to when potential jurors arrive to 15 minutes past that time, so we hit everyone in that pool (as well as anyone else who happens to walk in)

Glad that helps,

As you recall, Julian, you and I were arrested by Officer Ponce, then un-arrested by Sheriff Long, on the LA County Courthouse "steps" on April 15th two years ago.

Perhaps you could also show evidence of demonstrations staged on courthouse plazas by other interests that were not harassed, so as to argue "selective prosecution": demonstrations with messages that the reigning powers would have approved of, for example. Or anti-death penalty type demos that were not "permitted"... Of course if any demo there was ever permitted you could argue that it is indeed a public forum. be sure and show then Andrew Napolitano's YouTube vid too.

I was not.

Dear Julian,

This is Mike Paster. Every Monday from about 7:15am to 9:20am I offer FIJA flyers to anyone entering the San Diego Superior Court located in Vista, CA. (Northern San Diego County) I have never had any negative interaction with the police or court officials at this location. I offer anyone entering the building a flyer and simply say "Jury service information." If they ask me if I work for the court I honestly answer with "no". Bill Hasty and myself have been doing this for about a year at least. We used to rotate Mondays. Bill is an elderly gentleman with a family and hasn't been a participant for the past few months to the best of my knowledge.

Take care,

about a year ago, or more, I picketed INSIDE the BCJC in the waiting area of a Judge's chamber.
This judge had signed a totally bogus order that said it was ok for the Fort Lauderdale mafioso to bulldoze an elderly couple's property (where I was arrested).  About six BSO policemen and women and a dog came up to confront me.
The biggest guy asked my name.
I said Don Quixote de la Mancha
He said what are you doing ?
I said silent free speech
They left and did not bother me again until about an hour later and then left again ..
I was not arrested.
One of my proudest moments to tell ya the truth ..
I sent this out awhile ago ... but can't find my old email at the moment

Over the past century, legal scholars have argued that the Fourth Amendment . Exclusionary rule (the rule requiring illegally seized evidence to be excluded from evidence in subsequent criminal trials) was never intended by the Founders and Framers who drafted, debated and ratified the Constitution.  I have been researching this topic for some time, and have authored an article to be published in the Gonzaga Law Review in the Spring of 2010 entitled "The Originalist Case for the Fourth Amendment Exclusionary Rule." During my research, I identified several  pre-Founding books suggesting or stating that exclusion of evidence was the (or an)
appropriate remedy for violations of search-and-seizure rights.

You attended one or more FIJA pamphlet distribution with me.  Enclosed is a list of dates and locations.

I was arrested and convicted for violating a court order against such a distribution. on August 22, 2011, at the Orange County Courthouse in Orlando, FL.  Now I am suing the State of Florida for violating my First Amendment rights of freedom of speech and the press.

It is necessary for me to show that arrests were not made uniformly at other courthouses, thus indicating that courtyard plazas are public forums; and that I was not interfering with pedestrian traffic at those courthouses.

Summaries of all the FIJA distributions are given at: ???
Also descriptions of events regarding my arrest and subsequen court docuents are given at ????

I have enclosed an affidavit form that I would appreciate your filling out, have it notarized, and submitting the original to the court and a copy to me.  Also enclosed for your convenience is a list of distributions with dates, locations, and known participants.

Thank you for your help and cooperation.  Yours in freedom and justice.

I was arrested and convicted for violating a court order against pamphlet distribution. on August 22, 2011, at the Orange County Courthouse in Orlando, FL. The history of this case appears at: http://www.personal.psu.edu/faculty/j/p/jph13.  Now I am suing the State of Florida for violating my First Amendment rights of freedom of speech and the press.
It is necessary for me to show that the information distributed is correct and in keeping with United States legal processes and history.  Every effort must be made to eradicate the idea that I was active in a non-public forum or misleading  any potential or sitting juror.

If we can win this case, thus punishing a judge for violating his oath of office and committing perjury, we can end the harassment of jury nullification advocates.  Such a victory might save the nation from the abyss in which it is heading.
I know of 3 jury nullification cases in 2012: one each in Minnesota, New Hampshire and New Jersey.  (See my Petition for Justice at: http: //www.personal.psu.edu/faculty/j/p/jph13/Petition_for_justice_1-15-13.html).  With your continued zeal, we can increase this number to a crescendo.

CASE # 6:1–CV–1102–ORL–31–KRS

I plan to submit the enclosed MOTIONS and supporting documents to the U. S. District Court in Orlando, FL.  You already have received a copy of my “Petition for Justice.”  It also is posted at: http://www.personal.psu.edu/faculty/j/p/jph13/Petition_for_justice_1-15-13.html.  There will be an additional request to return the bail bond of $12,000, which will be added in the revised addition of the MOTIONS submitted to the court.  Also the FIJA distribution of May 14, 2010 at Wilmington, DE, U. S. District Courthouse was inadvertently omitted from Table 1. That document provides the supporting evidence and arguments for the attached MOTIONS.

In accordance with Local Rule 3.01, you are receiving the attached documents  for suggestions, objections, and/or approval.  According to Rule 3.01 (b) of the LOCAL RULES of the UNITED STATES DISTRICT COURT MIDDLE DISTRICT OF FLORIDA:

b) Each party opposing a motion or application shall file within fourteen (14) days after service of the motion or application a response that includes a memorandum of legal authority in opposition to the request, all of which the respondent shall include in a document not more than (20) pages.”

There is a lot of material to cover, so I will accept a deadline date of March 1, 2013 and 25-30 pages of text, if you need it.  I am not a stickler for those details, as long as the response time and length are reasonable.  I suspect the judges may not be so lenient.  My experience is that they are more interested in the process than the result.

In addition to your response, I also welcome comments by Attorney Sudbury and Plaintiff Schmidter.  Unless further discussion is warranted, these documents along with your response, and my reply to your response, will be sent to the U. S. District Court on March 1, 2013, or soon thereafter.

Also, I will contact potential expert witnesses and individuals who participated in FIJA distributions with me at courthouses for their comments.

I will request that they send their signed comments directly to the District Court with copies to me.  Then I will decide which comments to use at trial and send you copies.

“Local Rule 1.07(c) Service of a pleading or paper subsequent to the original complaint may be made by transmitting it by facsimile to the attorney’s or partys’ office with a cover sheet containing the sender’s name, firm, address, telephone number, and facsimile number, and the number of pages transmitted.  When service is made by the facsimile, a copy shall also be served by any other method permitted by rule 5, Fed. Cic. P. Service by delivery after 5:00 p.m. shall be deemed to have been made on the next business day.”

However, I will not be sending an additional copy of the attached documents by surface mail unless you request it.

I do not like a telephone conversation for 2 reason:
1. There is no record, and
2. A rapid response is required without much thought.  People say things they really do not mean, or mean but would not say if they had time to recover their senses.
